Terms and conditions for booking and using the vacation apartment

1 Scope of application

These General Terms and Conditions (GTC) govern the rental relationship between the landlord of the vacation apartment (atmysphere.de, represented by Matthias Severitt) and the tenant. By booking the vacation apartment, the tenant agrees to these GTC.

2 Conclusion of contract

The contract is concluded when the tenant makes a binding booking and the landlord confirms it. A confirmation is usually sent by e-mail.

3 Rental price and terms of payment


The rental price is stated in the booking confirmation and must be paid no later than 14 days before arrival. For bookings made at short notice (less than 14 days before arrival) the amount is due immediately. Payments can be made by bank transfer or, if offered, by credit card or other payment methods accepted by us.

4 Cancellation by the tenant

Cancellations are only possible in written form (e-mail or letter).

The following deadlines and conditions apply in the event of cancellation:

  • Up to 30 days before arrival: Refund of 80% of the rental price.
  • Up to 14 days before arrival: Refund of 50% of the rental price.
  • Less than 14 days before arrival: no refund.

It is recommended that you take out travel insurance to cover costs in the event of cancellation.

5. arrival and departure

The apartment can be occupied from 15:00 on the day of arrival. On the day of departure the apartment must be vacated by 11am at the latest.

6 Obligations of the tenant

By booking of the apartment the tenant agrees:

  • To use the vacation apartment only for the contractually agreed period.
  • To treat the apartment with care and to leave it in a tidy condition on departure.
  • To report any damage to the landlord immediately and to pay for any damage caused by his culpable actions.

7. pets

Pets are only permitted with the prior consent of the landlord. An additional fee may be charged for pets.

8. force majeure

In the event of force majeure (e.g. natural disasters, war, strike), the contract cannot be fulfilled or can only be partially fulfilled. In such cases, both parties are released from their obligation to perform. In the event of complete non-performance, the Hirer shall be reimbursed the amounts already paid.

9 Liability

The landlord is only liable for damage caused by gross negligence or intent on his part. The landlord accepts no liability for loss of or damage to the tenant's personal belongings.

10. loss of keys and loss report

The tenant receives one or more keys to the vacation apartment on arrival. The tenant undertakes to keep the keys carefully and to return them undamaged and complete to the landlord on departure. If the tenant loses the key or keys or if they are stolen, the tenant must inform the landlord immediately. The tenant shall bear the costs for the production of replacement keys and for any necessary changes to the locking system. The cost of making replacement keys and/or changing the locking system may be up to 200 euros per case (the exact amount may vary depending on the situation and locking system). The renter undertakes to bear these costs. The tenant is liable for all damage caused by the loss of the key, in particular for the costs of replacement and, if necessary, the security measures to change the locking system. The tenant must also ensure that the loss of the key does not jeopardize the security of the vacation apartment.


11. final provisions


Should individual provisions of these GTC be invalid or unenforceable, the remainder of the agreement shall remain unaffected. German law shall apply. The place of jurisdiction is the registered office of the lessor.
